Policy and Information
*Confirmation.
All reservations must be confirmed in writing, together with the with room deposit and signed information and Policies document, within 14 days of the tentative reservation.
Should any of the written confirmation, deposit or signed Information and Policies document not be received within this time frame, MoMos Function Room reserves the right to re-allocate or cancel any function space being held.
*Deposit.
Payment is needed for room hire & food once confirmed.
*Cancellation.
In the event of a cancellation (required in writing) the following refunds will occur, less any costs incurred by MoMo’s Function Room:
• Over 60 days of the proposed function date - 50% deposit refund.
• Within 60 days of the proposed function date - deposit is non-refundable
• Within 30 days of the proposed function date - deposit is non-refundable and a cancellation fee equivalent to the room rental or 25% of the estimated funtion value (whichever is greater will apply.
• Within 14 days of the proposed function date - deposit is non-refundable and a cancellation fee equivalent to the room rental or 50% of the estimated funtion value (whichever is greater will apply.
• Within 7 days of the proposed function date - deposit is non-refundable and a cancellation fee equivalent to the room rental or 100% of the estimated funtion value (whichever is greater will apply. )
Postponement of any event will be considered a cancellation. Management will reserve the right to re-allocate deposits to future bookings where circumstances warrant. NB: When an event is cancelled, any costs for a third party, as agreed to by the Client (which at all times includes The Client’s Agent/s), which are non-refundable to the Function Centre, or where a contract with a third party cannot be terminated without liability or cost to the Function room, will be charged to the Client.
*Guaranteed Numbers.
Minimum guaranteed guest numbers are required no less than 72 hours (3 working days) prior to an event and charges will be based on guaranteed numbers or final head count, whichever is greater. It is the responsibility of the Client to contact the Function room regarding final numbers. Where no guaranteed numbers are supplied, guest numbers as originally advised will be catered for and charged accordingly.
Reduction Charges.
*BYO.
The provision of BYO food and beverage is not permitted in the restaurant or in any function venue. The provision of BYO beverage is not permitted in the restaurant or in any function venue without prior consent of the Function room management.
*Additional Charges.
In the event a function should go beyond the agreed finish time and / or beyond midnight. An extra charge for room rate will charged accordingly to room rate for 2am.
*Function Details.
Function information such as menus, beverage agreements, audio visual requirements, room set-ups, starting and finishing times etc MUST be confirmed in writing no less than two (2) weeks prior to the event.
*Insurance.
The Function room will NOT accept any responsibility for any damage or loss of materials left on the property prior to, during or after a function. The Client is financially responsible for any damage sustained to the Function Room fittings, property or equipment, or for any injury to guests or contractors, prior to, during or after any event. The Client is advised to seek independent advice in relation to providing their own insurance cover.
*Compliance.
The Client will be responsible to ensure the orderly behaviour of their guests and the Function room reserves the right to intervene where it is deemed appropriate. The Funciton room reserves the right to request The Client to have mandatory security for any function it deems necessary. Our staff are practice responsible service of alcohol and regularly check I.D's.
*Signage.
Signage provided by The Client is restricted to the booked function venue and cannot be displayed in any public area without prior consent of the Function room management. Use of any adhesive on venue property is prohibited without prior consent of the Function room management.
*Pricing.
Quoted prices are valid for 30 days pending The Client’s official confirmation, and are relevant to the specifications contained therein. In the event that The Client, after confirmation of an event, decides to change the original booking (e.g. reduce numbers, cancel catering, etc) subsequently affecting the original prices quoted. The Function room reserves the right to requote according to the changes made to the original quoted booking. Prices are inclusive of GST, however are subject to change should government legislation increase current tax levels.
*Venue Bookings.
Note that any event space reserved during the day / evening is subject to re-letting for other functions during the day / evening unless alternative arrangements have been agreed upon.
*Commencement and Vacation of Room.
The Client agrees to begin the function and vacate the designated function space at the scheduled times agreed upon. In the event that a function
should go beyond the agreed finish time and if the following client is inconvenienced, The Function room reserves the right to charge whatever extra costs are reasonably incurred to ensure the smooth operation of the following function.
*Other Functions.
The Function Room reserves the right to book other functions in the same function room up to one hour before the scheduled function commencement time and one hour after the scheduled function finishing time.
*Outside Contractors.
For all exhibitions and stage set ups produced by outside contractors, plans must be approved by the Functions Manager a minimum of 30 days prior to the event. The outside contractors must liaise with the Functions Manager in all matters of delivery, set up and break down.The Function Room Management can supply our preferred supplier list.
*Payment.
All function accounts are to be made on the night of the event unless prior arrangements have been made with the Function Room Management.
Calculation will be based on guaranteed numbers provided 72 hours (3 working days) prior to the event. Increased numbers will be charged accordingly. Credit application, unless authorised by the Function Room Manager, will not apply to function reservations. Conference accounts must be paid on departure where credit facilities have not been established or approved. Credit application is available and account payment must be received within 7 days of invoice.
*Guarantee of Payment.
The Client’s signatory agrees with the Function Room to be personally liable to pay all monies payable to the MoMo’s Function Room pursuant with this agreement. Where it is requested by the Client that the Function Room address its invoice to another person, company or entity. The Client’s signatory agrees that his/her liability for payment is not thereby extinguished. In such circumstances, he/she shall be jointly and severally liable with the nominated person, company or entity for payment and that liability shall not be discharged until the Function Room has been paid in full. Liability. Where the Function Room has any reason to believe an event or function will affect the smooth operation of the Function Room Business, it reserves the right to cancel the event without notice or liability.
*Delivery and Collection of Goods.
Due to the limited storage space in the Function Room, goods can only be stored at our premises with prior arrangement (limits on size and volume do apply) but must be removed from the premises by the following day of the booked function. Goods left in the Function room and not collected the following day will be deemed abandoned.
*Laws and Regulations.
At no time will The Client commit any act or permit its employees, agents or invitees to commit any act that is illegal, noisome or offensive or is in breach of the Function Rooms rules or any statues, by-laws, orders, regulations or other provisions having the force of the law including, but not limited to, the Function Rooms Liquor Licence, Fire Regulations and Health and Safety Requirements.
*Force Majeure.
In the case of events such as earthquake, fire, flood, cyclone, civil disturbance or industrial action preventing either The Client or the Function room from carrying out their obligations under this agreement, neither The Client or the Function Room shall be liable for the non-performance of this agreement. In the event The Client cancels for any reasons of Force Majeure, all payments and the initial deposit will be refunded. In no event shall the Function room be liable for the loss of profit or consequential damages whether based on breach of contract, warranty or otherwise.
*Entire Agreement.
Subject to only variations specified in a subsequent event order signed by The Client, this Information & Policies document constitutes the entire agreement of the parties and shall supersede all prior offers, negotiations and agreements in connection with the function.
